These Terms of Service ("Terms") govern your use of the Midcent desktop application ("Midcent," "the app," or "the software") provided by Midcent ("we," "us," or "our"). By downloading, installing, or using Midcent, you agree to these Terms. If you do not agree, do not use the software.

1. License grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Midcent on your personal computer for personal or professional writing purposes, subject to these Terms.

2. Your content

Midcent is a local-first application. All documents, chapters, versions, snapshots, and associated content you create in Midcent ("your content") are stored entirely on your computer in standard file formats. We do not host, access, transmit, or store your content on any server.

You retain full ownership of your content. We claim no rights to anything you write in Midcent. You are solely responsible for backing up and safeguarding your files.

3. Local data storage

Midcent stores your writing projects as files on your local file system. This means your data never leaves your machine through Midcent. Because your content is stored locally, you are responsible for maintaining backups, managing disk space, and ensuring the security of your device.

4. Purchases and payments

If Midcent is offered as a paid product, purchases are processed through our third-party payment provider, Lemon Squeezy. By making a purchase, you also agree to Lemon Squeezy's terms of service. We do not directly handle or store payment card information.

5. Refund policy

If you are not satisfied with Midcent, you may request a refund within 14 days of purchase. Refund requests can be submitted by contacting us at the email address listed below. Refunds are processed through Lemon Squeezy and may take several business days to appear on your statement.

6. Restrictions

You agree not to:

• Reverse engineer, decompile, or disassemble the software
• Redistribute, sublicense, or resell Midcent without our written permission
• Remove or alter any proprietary notices or labels
• Use Midcent in any way that violates applicable law

7. Updates

We may release updates to Midcent from time to time. These updates may include bug fixes, new features, or changes to existing functionality. Updates are optional unless otherwise noted, and these Terms apply to all updated versions of the software.

8. Intellectual property

Midcent, including its design, code, visual assets, and branding, is the intellectual property of Midcent and is protected by copyright and other applicable laws. These Terms do not transfer any intellectual property rights to you beyond the limited license described above.

9. Disclaimer of warranties

Midcent is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the software will be error-free, uninterrupted, or free of harmful components. You use Midcent at your own risk.

10. Limitation of liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Midcent, including but not limited to loss of data, loss of profits, or damage to your device. Our total liability for any claim shall not exceed the amount you paid for Midcent in the twelve months preceding the claim.

11. Termination

You may stop using Midcent at any time by uninstalling the software. We may terminate your license if you violate these Terms. Upon termination, you should uninstall Midcent. Your locally stored content remains yours regardless of termination.

12. Changes to these terms

We may update these Terms from time to time. Changes will be posted on our website and take effect upon posting. Continued use of Midcent after changes constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.
